Ai-Fi.net, Incorporated (the “Ai-Fi” or "We"), a Delaware corporation, utilizes state-of-the-art security and end-to-end encryption technology to provide private messaging, secure emailing, crypto wallets, Internet addressability and other services for private/home servers, and other services to users worldwide. This Non-Commercial Service Agreement (Agreement) is between Ai-Fi and you, the entity or individual entering into this Agreement (User).

You agree to our Terms of Service (“Terms”) by installing or using our applications, services, software, or related documents published in ai-fi.net websites (together, “Services”, "Core Services"). BY "USING" THE SERVICES YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, UNDERSTAND THEM, AND AGREE TO BE LEGALLY BOUND BY THEM. If you do not agree with the terms of this Agreement, you may not install or use the Ai-Fi licensed materials or the Ai-Fi Services. Other non-Core-Services, such as community forum, promotional campaign, airdrop award program, etc., involving Ai-Fi directly or indirectly, are covered by their own Terms of Service and Privacy Policy separately.

Ai-Fi Services are designed to never collect or store any sensitive information. Ai-Fi-protected emailing, including its associated content, encryption, transport, and delivery, cannot be accessed by us or other third parties because they are always end-to-end encrypted, private, and secure.

The end points in any end-to-end transactions referred to within the Ai-Fi Services context are further described here.

Scope

This Agreement describes the terms of Services provided to User on a non-commercial basis. If User desires to use the Services on a commercial basis, it must separately acquire a commercial-use license from Ai-Fi.

Terms of Service

Updates

Ai-Fi may update the Terms from time to time. When we update our Terms, we will update the “Last Modified” date associated with the updated Terms. Your continued use of our Services confirms your acceptance of our updated Terms which supersedes any prior Terms. You will comply with all applicable export control and trade sanctions laws. Our Terms cover the entire agreement between you and Ai-Fi regarding our Services. If you do not agree with our Terms, you should stop using our Services.

If we fail to enforce any of our Terms, that does not mean we waive the right to enforce them. If any provision of the Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from our Terms and shall not affect the enforceability of the remaining provisions. Our Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country. About our Services

Minimum Age. You must be at least 13 years old to use our Services. The minimum age to use our Services without parental approval may be higher in your home country.

No Registration. Ai-Fi Services embraces privacy by design and is account-less without requiring users to register. It does include a payment scheme through a cryptocurrency wallet, the Ai-Fi Wallet ("Wallet"), from which users make payments for services rendered on a per-transaction basis. Currently the Wallet accepts XLM (Lumen) of Stellar Network as the cryptocurrency for service payment. Unlike the traditional user registration account, which invariably is tied to some user PII (Personally Identifiable Information), Ai-Fi Wallet takes advantage of the proven permissionless Blockchain technology in achieving the pseudonymity for our users.

Privacy of user data. Ai-Fi does not sell, rent or monetize your personal data or content in any way. Please read our Privacy Policy to understand how we safeguard the information you provide to us when using our Services. For the purpose of operating our Services, you agree to our data practices as described in our Privacy Policy, as well as the transfer of your encrypted information and metadata to the United States and other countries where we have or use facilities, service providers or partners. Examples would be Third Party Providers sending you a verification code and processing your support tickets.

Software Updates. In order to enable new features and enhanced functionality, you consent to downloading and installing updates to our Services.

Fees and Taxes. You are responsible for data and mobile carrier fees and taxes associated with the devices on which you use our Services. For Ai-Fi Services rendered, you may be charged a fee based on a published fee schedule. The requests for those chargeable Ai-Fi Services are usually accompanied with crypto addresses generated by the Ai-Fi Wallet from which the payments are to be made.

Using Ai-Fi Services

Our Terms and Policies. You must use our Services according to our Terms and posted policies. We may disable any payment account and its associated digital assets, if any, for suspicion of violating our Terms, under which circumstance You will not re-submit any new service requests with other payment accounts without our permission.

Legal and Acceptable Use. You agree to use our Services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our Services in ways that: (a) violate or infringe the rights of Ai-Fi, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, and auto-dialing.

Harm to Ai-Fi. You must not (or assist others to) access, use, modify, distribute, transfer, or exploit our Services in unauthorized manners, or in ways that harm Ai-Fi, our Services, or systems. For example you must not (a) gain or try to gain unauthorized access to our Services or systems; (b) disrupt the integrity or performance of our Services; (c) access our Services through unauthorized or automated means; (d) collect information about our users in any unauthorized manner; or (e) sell, rent, or charge for our Services.

Keeping Your Ai-Fi Wallet Secure. You are responsible for keeping your device and your Wallet safe and secure. If you lose your phone, follow the steps in our documentation or on our Support site to recover your Ai-Fi Wallet and its various associated Ai-Fi Service contexts. When you create a new Ai-Fi Wallet on the same device, your device will stop receiving all messages and calls destined to the old Ai-Fi Wallet.

No Access to Emergency Services. Our Services do not provide access to emergency service providers like the police, fire department, hospitals, or other public safety organizations. Make sure you can contact emergency service providers through a mobile, fixed-line telephone, or other service.

Third-party services. Our Services may allow you to access, use, or interact with third-party websites, apps, content, and other products and services. When you use third-party services, their terms and privacy policies govern your use of those services.

Your Rights and License with Ai-Fi Services

Your Rights. You own the information you submit through our Services. You must have the rights to the Ai-Fi Wallet you use to pay for your consumed Ai-Fi Services.

Ai-Fi’s Rights. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our written permission. To report copyright, trademark, or other intellectual property infringement, please contact report@Ai-Fi.net.

Ai-Fi’s License to You. Subject to the other terms of this Agreement, Ai-Fi grants you a limited, revocable, non-exclusive, non-transferable, non-commercial license to:

  1. Use the Services only (i) in a personal capacity, (ii) in an educational institution environment, or (iii) for non-commercial, evaluation purposes in User’s internal business operations
  2. Make derivative works of the source code snippets provided with the software of the Services, and to operate and distribute such derivative works, but only when combined with Ai-Fi Software.

Disclaimers and Limitations

Disclaimers. YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. WE PROVIDE OUR SERVICES ON AN “AS IS” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE. Ai-Fi DOES NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR-FREE, SECURE, OR SAFE, OR THAT OUR SERVICES WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, CONTROLLING HOW OR WHEN OUR USERS USE OUR SERVICES. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR INFORMATION (INCLUDING CONTENT) OF OUR USERS OR OTHER THIRD PARTIES. YOU RELEASE US, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AND AGENTS (TOGETHER, “Ai-Fi PARTIES”) FROM ANY CLAIM, COMPLAINT, CAUSE OF ACTION, CONTROVERSY, OR DISPUTE (TOGETHER, “CLAIM”) AND DAMAGES, KNOWN AND UNKNOWN, RELATING TO, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH ANY SUCH CLAIM YOU HAVE AGAINST ANY THIRD PARTIES.

Limitation of liability. THE Ai-Fi PARTIES WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES, EVEN IF THE Ai-Fi PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THE FOREGOING DISCLAIMER OF CERTAIN DAMAGES AND LIMITATION OF LIABILITY WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE LAWS OF SOME STATES OR JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN OUR TERMS, IN SUCH CASES, THE LIABILITY OF THE Ai-Fi PARTIES WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Availability of Our Services. Our Services may be interrupted, including for maintenance, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and the support for certain devices and platforms, at any time.

Resolving Disputes and Ending Terms

Resolving disputes. You agree to resolve any Claim you have with us relating to or arising out of our Terms, us, or our Services exclusively in the United States District Court for the Northern District of California or a state court in San Mateo County, California. You also agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such disputes. The laws of the State of California govern our Terms, as well as any disputes, whether in court or arbitration, which might arise between Ai-Fi and you, without regard to conflict of law provisions.

Ending these Terms. You may end these Terms with Ai-Fi Services at any time by deleting Ai-Fi Central from your device and discontinuing use of our Services. We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our Terms or create harm, risk, or possible legal exposure for Ai-Fi. The following provisions will survive termination of your relationship with Ai-Fi: “Licenses,” “Disclaimers,” “Limitation of Liability,” “Resolving dispute,” “Availability” and “Ending these Terms,” and “General”.


Privacy Policy

Ai-Fi Services utilize state-of-the-art security and end-to-end encryption to provide private messaging, emailing, and Internet file services to users worldwide (“Services”). Your calls and messages are always encrypted, so they can never be shared or viewed by anyone but yourself and the intended recipients.

Information You Provide

No Registration or Profile. Ai-Fi Services embrace privacy by design and are account-less without requiring users to register. Without requiring sign-up or account, your activity relative to Ai-Fi Services is not aggregated and/or recorded. The support of Tor Network further anonymizes users' access to the Services.

End Points. Ai-Fi Services provide secure messaging, device discovery, Internet addressability and routing services for the following end points owned and operated by individual users:

Messages. Ai-Fi Services cannot decrypt or otherwise access the content of your messages or calls. Ai-Fi Services sometimes queue end-to-end encrypted messages on its servers for certain Ai-Fi applications for delivery to devices that are temporarily offline (e.g. a phone whose battery has died). Your message history is stored on your own devices.

You may opt to store additional technical information on our servers, including randomly generated authentication tokens, keys, push tokens, and other material that is necessary to establish calls and transmit messages. Ai-Fi Services limit this additional technical information to the minimum required to operate the Services. In most cases you are allowed to use your own servers for assisting or facilitating Ai-Fi Services.

Ai-Fi Incognito Clouds. Ai-Fi users may store their files in the Ai-Fi Incognito Clouds as Krypton/Crypton Tokens, each is individually encrypted and retrievable by user end devices according to the Crypton Token protocol without sharing key information with Ai-Fi Services. There is no PII involved in this class of transactions.

Ai-Fi Services Involving PII. As the service infrastructure is account-less, it does not have the ability to attribute any service activities or data to any specific personal identity except the following functional elements in the Ai-Fi Binding Registry:

With plenty of publicly available "burner" email accounts available at minimal or no cost, those PlexiMail binding addresses and wallets are turned into PII only when a user choses to allow them, in which case only public keys are published in the Registry but the metadata about the owner of those email addresses are also exposed. This binding information may be removed by simply going into the Settings of the Ai-Fi Mobile app and Reset the email addresses bound to those Services.

The content of the Ai-Fi Binding Registry may be backed up periodically for the express purpose of disaster recovery. This backup is thoroughly cleared from our storage devices as soon as it becomes outdated by newer recovery backups. This recycle period is typically no longer than 6 months.

User Forum and Marketing Campaign. There are a few r web-based support and marketing activities that may involves the collection of user data, outside of Ai-Fi Core Services, exampled below:

PII Information collected in aforementioned cases outside of the Ai-Fi Core Services are strictly firewalled against cross-referencing and bundling from Ai-Fi Services. Our Services may contact individual Ai-Fi users by sending emails to them for matters such as release announcement, new product status and other generic notifications to our users. This use of those email addresses collected through the binding process is generic and totally insulated from the operations of our Services.

User Support. If you contact Ai-Fi User Support, any personal data you may share with us is kept only for the purpose of researching the issue and contacting you about your case.

Managing your information. Ai-Fi Services are account-less and therefore keeps no user information. However, you may find some profile information handy while interacting with your personal or business partners. You can manage your personal information in Ai-Fi’s application Settings, which is relevant only to your private end-to-end social networking. For example, you can update your profile information or choose to enable additional privacy features like the device Lock PIN.

Information We May Share

Third Parties. We work with third parties to provide some of our Services. For example, our Third-Party Providers send a verification code to your device when you sign up for our PlexiMail Services. These providers are bound by their Privacy Policies to safeguard that information. If you use other Third-Party Services like Gmail, Outlook or Hotmail mail, Yahoo Mail, YouTube, Spotify, Giphy, etc. in connection with our Services, their Terms and Privacy Policies govern your use of their respective services.

Updates

We will update this privacy policy as needed so that it is current, accurate, and as clear as possible. Your continued use of our Services confirms your acceptance of our updated Privacy Policy.

Ai-Fi and the General Data Protection Regulation (GDPR)

Ai-Fi is committed to protecting your privacy and the security of your data. Ai-Fi cannot sell, rent, or monetize your data or content in any way.

The information provided below applies only to those products and services included in the Ai-Fi Core Services with the documented Terms of Service and Privacy Policy.

Updated Terms and privacy policy

Ai-Fi Services are designed to never collect or store any sensitive information. Ai-Fi messages and calls cannot be accessed by us or other third parties because they are always end-to-end encrypted, private, and secure.

Can I export my data out of Ai-Fi?

Ai-Fi messages, pictures, files, and other contents are stored locally on your devices. These contents are readable by the Ai-Fi clients based on the Open Ai-Fi Standards. Because everything in Ai-Fi is end-to-end encrypted, the Ai-Fi services do not have access to this data.

How do I permanently disable my account?

You can permanently disable your mobile phone from being recognized as an Ai-Fi user by resetting or deleting your Wallet. You will need physical access to the mobile phone where your Wallet resides to verify and complete this action.

What about other information in Ai-Fi?

Ai-Fi does not store any PII related information under any circumstances. That information resides solely on your device, on an publicly available Blockchain, or in their encrypted form stored as Ai-Fi Krypton Tokens.

What efforts is Ai-Fi taking to comply with GDPR?

Ai-Fi is specifically designed to protect user privacy and uses only the minimum information needed to deliver our service. This is an evolving process, and we will continue to update Ai-Fi's Privacy Policy & Terms along with our Support Center content.
