Ai-Fi.net Terms & Privacy Policy

In the following, Ai-Fi.net refers to the various services offered by Ai-Fi.net, Incorporated (the "Company" or "We"), a Delaware corporation, through the Ai-Fi.net website and the software provided by the company (the "Service").

General

Ai-Fi.net may update the Terms from time to time. When we update our Terms, we will update the “Last Modified” date associated with the updated Terms. Your continued use of our Services confirms your acceptance of our updated Terms and supersedes any prior Terms. You will comply with all applicable export control and trade sanctions laws. Our Terms cover the entire agreement between you and Ai-Fi.net regarding our Services. If you do not agree with our Terms, you should stop using our Services.

If we fail to enforce any of our Terms, that does not mean we waive the right to enforce them. If any provision of the Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from our Terms and shall not affect the enforceability of the remaining provisions. Our Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country. We reserve the right to limit our Services in any country. If you have specific questions about these Terms, please contact us at privacy@ai-fi.net.

Terms of Service

Ai-Fi.net (“Ai-Fi.net”) offers account verification, authentication, and end-to-end encryption services for its registered users in order to provide secure email, private messaging, Internet calling, and other VPN services (Ai-Fi Domains) deployable worldwide. You agree to our Terms of Service (“Terms”) by installing or using our applications, services, or website (collectively the “Service(s)”).

Ai-Fi.net is designed to never collect or store any sensitive personal information. Private Ai-Fi.net emails, messages, calls, and any data traffic administrated through Ai-Fi Domain, cannot be deciphered by us or other third parties because they are always end-to-end encrypted, private, and secure, with the users managing their own keys. By registering or using any of the Services you agree to be bound by our Terms of Service and Privacy Policy, detailed below.

About our services

Minimum Age. You must be at least 13 years old to use our Services. The minimum age to use our Services without parental approval may be higher in your home country.

Account Registration. To obtain access to our services you may be required to register for an Ai-Fi Account using your mobile phones. You agree to receive application messages from us through your registered account. We do not record your phone numbers of the phones that you use to register with Ai-Fi.net.

Privacy of user data. Ai-Fi.net does not sell, rent or monetize your personal data or content in any way.

Please read our Privacy Policy to understand how we safeguard the information you provide when using our Services. For the purpose of operating our Services, you agree to our data practices as described in our Privacy Policy, as well as the transfer of your encrypted information and metadata to the United States and other countries where we have or use facilities, service providers or partners. Examples would be Third Party Providers sending you a verification code, verification emails, and processing your support tickets.

Software. In order to enable new features and enhanced functionality, you consent to downloading and installing updates to our Services.

Fees and Taxes. You are responsible for data and mobile carrier fees and taxes associated with the devices on which you use our Services.

Using Ai-Fi.net

Our Terms and Policies. You must use our Services according to our Terms and posted policies. If we disable your account for a violation of our Terms, you will not create another account without our permission.

Legal and Acceptable Use. You agree to use our Services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our Services in ways that: (a) violate or infringe the rights of Ai-Fi.net, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, emails, and auto-dialing.

Harm to Ai-Fi.net. You must not (or assist others to) access, use, modify, distribute, transfer, or exploit our Services in unauthorized manners, or in ways that harm Ai-Fi.net, our Services, or systems. For example you must not (a) gain or try to gain unauthorized access to our Services or systems; (b) disrupt the integrity or performance of our Services; (c) create accounts for our Services through unauthorized means; (d) collect information about our users in any unauthorized manner; or (e) sell, rent, or charge for our Services. This Service is provided exclusively to persons. Accounts registered by “bots” or automated methods are not authorized and will be terminated. Each user is solely responsible for all of his or her actions related to the use of the Service.

Keeping Your Account Secure. Ai-Fi.net embraces privacy by design and does not have the ability to access your Ai-Fi Mail, messages, or data traffic. You are responsible for keeping your device and your Ai-Fi.net account safe and secure. If you lose your phone, follow the steps on our Support site to re-register for our Services. When you register with a new device, your old device will stop receiving all emails and messages, and calls.

No Access to Emergency Services. Our Services do not provide access to emergency service providers like the police, fire department, hospitals, or other public safety organizations. Make sure you can contact emergency service providers through a mobile, fixed-line telephone, or other service.

Third-party services. Our Services may allow you to access, use, or interact with third-party websites, apps, content, and other products and services. When you use third-party services, their terms and privacy policies govern your use of those services.

Your Rights and License with Ai-Fi.net

Your Rights. You own the information you submit through our Services. You must have the rights to the email addresses you use to sign up for your Ai-Fi Mail account.

Ai-Fi.net’s Rights. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our written permission. To report copyright, trademark, or other intellectual property infringement, please contact abuse@ai-fi.net.

Ai-Fi.net’s License to You. Ai-Fi.net grants you a limited, revocable, non-exclusive, and non-transferable license to use our Services in accordance with these Terms.

Disclaimers and Limitations

Disclaimers. YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. WE PROVIDE OUR SERVICES ON AN “AS IS” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE. Ai-Fi.net DOES NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR-FREE, SECURE, OR SAFE, OR THAT OUR SERVICES WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, CONTROLLING HOW OR WHEN OUR USERS USE OUR SERVICES. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR INFORMATION (INCLUDING CONTENT) OF OUR USERS OR OTHER THIRD PARTIES. Limitation of liability. THE Ai-Fi.net PARTIES WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES, EVEN IF THE Ai-Fi.net PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THE FOREGOING DISCLAIMER OF CERTAIN DAMAGES AND LIMITATION OF LIABILITY WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE LAWS OF SOME STATES OR JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN OUR TERMS, IN SUCH CASES, THE LIABILITY OF THE Ai-Fi.net PARTIES WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Availability of Our Services. Our Services may be interrupted, including for maintenance, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and the support for certain devices and platforms, at any time.

Resolving Disputes and Ending Terms

Resolving disputes. You agree to resolve any Claim you have with us relating to or arising out of our Terms, us, or our Services exclusively in the state or federal courts located in Los Angeles County, California. You also agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such disputes. The laws of the State of California govern our Terms, as well as any disputes, whether in court or arbitration, which might arise between Ai-Fi.net and you, without regard to conflict of law provisions.

Ending these Terms. You may end these Terms with Ai-Fi.net at any time by deleting Ai-Fi.net applications from your device and discontinuing use of our Services. We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our Terms or create harm, risk, or possible legal exposure for Ai-Fi.net. We may terminate your account if it has not been accessed in two years or more. The following provisions will survive termination of your relationship with Ai-Fi.net: “Licenses,” “Disclaimers,” “Limitation of Liability,” “Resolving dispute,” “Availability” and “Ending these Terms,” and “General”.


Privacy Policy

Ai-Fi.net utilizes end-to-end encryption to provide secure email, private messaging, and Internet calling services to users worldwide (“Services”). Your calls and messages are always encrypted, so they can never be shared or viewed by anyone but yourself and the intended recipients.

Information you provide

Account Information. When you first apply for an Ai-Fi.net account in order to use our services, you register with us an account name or identifier of your choosing. By design, your Ai-Fi Account identifier is not associated with any of your PII (Personally Identifiable Information), such as your emails, phone numbers, credit card numbers, social security number, or any other information traceable to your real name or person. All your interaction with your circle of other Ai-Fi users is end-to-end encrypted without the risk of leaking your PII to Ai-Fi.net and any other third parties. This protection of end-to-end encryption is effected by multiple pairs of keys based on public key cryptography. The associated private keys are stored on your private devices physically and exclusively that are further protected by your own private passcode.

Ai-Fi PID (Public Interface Directory). Ai-Fi.net maintains a directory for our users to declare their public interface parameters in order for them to receive requests from entities external to their Ai-Fi Domain. The following classes of information may be entered into this Ai-Fi PID:

This directory is logically and physically separated from the account database management system internal to Ai-Fi.net. To enter data into this Ai-Fi Public Interface Directory, the owning Ai-Fi accounts are individually authorized by Ai-Fi.net without recording the linkage between the Ai-Fi Account and its accounts published through this Public Interface Directory.

Email Service Provider Interfaces. To support our Ai-Fi Mail service, we utilize OAuth 2.0 authentication with your email service providers, with whom your email addresses are registered originally, in order to authorize your entering your email addresses into the Ai-Fi Public Interface Directory. Once authenticated and proven that you are the rightful owner of your email accounts, you are then allowed to publish data through the Ai-Fi PID in order to facilitate your secure email correspondence with your circle of friends. The actual email sending/receiving are conducted through the standard SMTP/IMAP interfaces per the service requirements of individual service providers and our Ai-Fi Mail client software you've installed. They are carried out end-to-end without involving other cloud services of Ai-Fi.net for reasons of security and privacy, except the information published and managed by the users themselves in the Ai-Fi Public Interface Directory. Ai-Fi.net does not involve in the transmission or storage of your emails. Ai-Fi.net does not store in its servers your PKI key pairs, passwords, phone numbers, or any other credentials necessary to access your emails with your service providers. Those private and personal email credentials reside physically and exclusively on the processing platform where your client software is operated from. You can revoke the OAuth access, delete your published entries in Ai-Fi Public Directory, or uninstall our Ai-Fi Mail application at any time.

Below is a list of currently supported email service providers:

Messages. Ai-Fi.net cannot decrypt or otherwise access the content of your Ai-Fi Mail, messages, or calls. Ai-Fi.net sometimes queues end-to-end encrypted messages on its servers for delivery to devices that are temporarily offline (e.g. a phone whose battery has died). Your message history is stored on your own devices.

Additional technical information is stored on our servers, including randomly generated authentication tokens, keys, push tokens, and other material that is necessary to establish calls and transmit messages. Ai-Fi.net limits this additional technical information to the minimum required to operate the Services.

Private Network Configuration and Traffic. If you use Ai-Fi.net's Ai-Fi Doman security functions or services, Ai-Fi.net will not log any of your data traffic or the content of your communications. We maintain a copy of your Ai-Fi Domain configuration, partially encrypted for your privacy protection based on your account credentials, on our servers in order to provide the traditional VPN routing and remote access functions for you and your contacts. Your contacts connected to your Ai-Fi Domain through our remote access functions are maintained on your ACL (Access Control List), for which Ai-Fi.net has no visibility. There is no access logs maintained by Ai-Fi.net.

Contacts. The Ai-Fi client software you install on your devices can optionally discover indirectly which contacts in your address book are Ai-Fi.net users, using the Ai-Fi.net PID service. Information from the contacts on your device may be briefly transmitted to the PID service in order to determine which of your contacts are registered. Ai-Fi.net servers are not involved in discovering your circle of contacts except the Public Interface Directory, which only provides fragmentary record about individual public accounts without any knowledge of their affiliaiton.

User Support. If you contact Ai-Fi.net User Support, any personal data you may share with us is kept only for the purposes of researching the issue and contacting you about your case.

Managing your information. You can manage your personal information in Ai-Fi.net’s application or configuration Settings. For example, you can update your profile information or choose to enable additional privacy features.

Information we may share

Third Parties. We work with third parties to provide some of our Services. For example, our Third-Party Providers send a verification code to your phone number when you register for our Services. These providers are bound by their Privacy Policies to safeguard that information. If you use other Third-Party Services like YouTube, Spotify, Giphy, etc. in connection with our Services, their Terms and Privacy Policies govern your use of those services.

Other instances where Ai-Fi.net may need to share your data.

We will only disclose the limited user data we possess if we receive notice from the authorities we are legally obligated to recognize. If permitted by law, we will always contact a user first before any data disclosure. We may from time to time, contest court orders if there is a public interest in doing so. In such situations, the Company will not comply with the court order until all legal or other remedies have been exhausted.

Ai-Fi.net subscriber account information. Ai-Fi.net only maintains the following information about our subscribers:

  1. In the Ai-Fi.net account database: Ai-Fi account name, the time of account creation, the associated secondary device identifiers, and the date of the last connection to Ai-Fi.net.
  2. In the Ai-Fi.net Public Interface Directory: The email addresses of the registered Ai-Fi Mail account, the time of their registration with the directory, and the date of the last inquiry by other Ai-Fi Mail account. The Ai-Fi Mail account has no linkage to its associated Ai-Fi.net account.

Stored on the persistent storage of Ai-Fi.net central servers, these are the only types of information that fall within the categories listed at Electronic Communications Privacy Act, 18 U.S.C. § 2703(c)(2).

Auditing of Ai-Fi Authentication Service

Architecturally, the bedrock of Ai-Fi.net support for Ai-Fi Domain VPN functions and for private affiliations between individual Ai-Fi accounts is built on the following design principles:

  1. The pseudonymity of Ai-Fi Accounts, which are not linked to any PII (Personal Identifiable Information) of the account owners.
  2. The consistency and trustworthiness of the PID (Public Interface Directory).

The design principle #1 is implemented through the construct of the AC (AnonymousCloud). The principle #2 is implemented by offering an audit mechanism for our internal Ai-Fi Account databases and the PID (Public Interface Directory), based on the open framework of CT (Certificate Transparency), involving one or many CT Logs, with the lightweight CT Auditor components built into our Ai-Fi client software. Those adopted CT Logs are immutable, reflect the content of all account information published by our users through Ai-Fi.net, and make all Ai-Fi.net operations transparent to our users who issue status entries to those CT Logs when related account data has been changed and periodically conduct integrity checks on their published data for potential unwarranted modifications. These audit trails recorded in the selected CT Logs are managed by our users and not under the purview of Ai-Fi.net.

Updates

We will update this privacy policy as needed so that it is current, accurate, and as clear as possible. Your continued use of our Services confirms your acceptance of our updated Privacy Policy. We may from time to time, contest court orders if there is a public interest in doing so. In such situations, the Company will not comply with the court order until all legal or other remedies have been exhausted.
